Civil Litigation
FAQs
-
Civil litigation involves legal disputes between individuals, businesses, or organizations seeking compensation or specific performance, rather than criminal punishment. Unlike criminal law, where the government prosecutes a defendant for a crime, civil litigation deals with private disputes over issues such as contracts, property, or negligence.
In Ontario, civil cases are resolved in civil courts such as the Small Claims Court or the Superior Court of Justice, depending on the complexity and value of the case.
-
The duration of a civil litigation case depends on several factors, including the complexity of the dispute, the court’s schedule, and whether the case is settled before trial.
Simple cases (e.g., Small Claims Court disputes) may take 6-12 months.
More complex cases (e.g., property disputes or professional negligence claims) can take 1-3 years or longer if they proceed to trial.
At MQLS we aim to resolve disputes efficiently while ensuring your rights are fully protected.
-
If you’ve been served with a lawsuit:
Read the documents carefully. Note the claims against you and the deadline to respond.
Seek legal advice immediately. Contact a civil litigation lawyer to assess your case and develop a defense strategy.
File a response. Depending on the court and type of claim, you may need to file a Statement of Defence or another document.
Failing to by the deadline could result in a default judgment against you.
-
Yes, most civil litigation cases in Ontario are resolved through settlement rather than trial. Settlement options include:
Negotiation: Direct discussions between parties or their lawyers.
Mediation: A neutral third party facilitates a resolution.
Arbitration: A binding decision is made by an arbitrator.
Settling out of court can save time, reduce costs, and allow for more control over the outcome.
-
The typical steps in a civil litigation case in Ontario are:
Pleadings: Filing a Statement of Claim and Statement of Defence.
Discovery: Exchanging relevant information and conducting examinations.
Motions: Addressing specific legal issues before trial.
Settlement Discussions: Attempting to resolve the case without trial.
Trial: Presenting evidence and arguments to a judge (and possibly a jury).
Judgment: The court delivers its decision.
Our firm guides you through each step with expertise and clarity.
-
Civil litigation covers a wide range of disputes, including:
Breach of contract.
Employment disputes (e.g., wrongful termination).
Debt collection.
Professional negligence claims.
Tort lawsuits

Ontario’s Personal Injury Framework
Ontario follows a "no-fault insurance" system for motor vehicle accidents, meaning victims can access accident benefits through their insurance regardless of fault. However, a lawsuit can be pursued against an at-fault party for pain and suffering or economic loss beyond a certain threshold.
The Limitations Act, 2002 typically requires personal injury lawsuits to be filed within 2 years from the date the injury was discovered.
If you are at fault you have the right to seek costs for treatment and other compensation from your insurance company
If you are not at fault you have the right to seek costs for treatment and other compensation from your insurance company as well as the right to the sue the person that caused your injury.
